The Supreme Court on Monday issued an instruction to the Agra Development Authority to immediately halt all commercial activities within 500m of the Taj Mahal perimeter wall.
The bench comprising Judges Sanjay Kishan Kaul and Abhay S. Okissued the following instructions in order to protect the iconic site, “We permit prayer and therefore IA ‘A’ Prayer No. 91272/2022 reads: ‘Directs the Agra Development Authority to suppress all commercial activities within 500 meters of the boundary/perimeter wall of the Taj Mahal monument which must be in harmony with Article 14 of the Constitution of India”.
Management came on a request from a group of shop owners who had been allocated an area outside the 500m radius to run their businesses. They informed the court through the request that illegal business activities are taking place near the Taj, which is in clear violation of previous orders issued by the court.
Lawyer MC Dhingra representing the claimants implored the court to issue orders to cease all these operations and asked the authorities to ensure strict compliance with the orders. Amicus Curiae on the matter, Senior Counsel ADN Rao also backed the proposal that it would be in the interest of the monument that instructions be issued ending all commercial activities taking place near the heritage site of the monument. ‘UNESCO.
In previous hearings, the Apex Court has passed various orders in a public interest litigation filed by environmental lawyer MC Mehta in 1984, to strike a balance between developments occurring in the region and the protection of the great mausoleum built by Mughal Emperor Shah.
