NEW DELHI: The Supreme Court on Friday rejected a plea filed by a survivor in a sexual assault case in which actor Dileep is accused, asking that the case be transferred to another lower court.

The survivor had alleged that Dileep, the eighth defendant in the case, had close ties to the trial judge and her husband.

A panel of judges Ajay Rastogi and CT Ravikumar said the Kerala High Court had already decided the issue of bias in its judgment.

Rejecting the claims of the applicant, the high court had, on September 22, declared itself firmly convinced that its apprehensions concerning a possible interference in a fair trial were not reasonable.

“It is possible that the frequent discussions and debates carried out and conducted by various news channels in connection with this case over several days and months have created a bad perception of the trial of the case, and this has apparently influenced the general public, including the petitioner While I find this petition to be submitted by the petitioner in good faith, I have every reason to assume that she is a victim of such misperceptions and slander created by the media,” the High Court had said. .

The applicant had argued that she would not get justice if the lower court was not changed and that the trial would not be fair.

It is also on the plea of ​​the survivor that the high court had, in 2018, set up a special court with a female judge for the trial which had started in 2020.

The survivor, in her plea, also alleged that there were several instances where the special prosecutor was unable to proceed with the trial and that there were repeated and persistent attempts by Dileep influence and intimidate witnesses.
