The Supreme Court on Tuesday upheld a three-year prison sentence for a public servant in a lower court that found him guilty of fraud and issuing bad checks.
Judge Kong Tarachhath identified the defendant as Ma Chinthean, 45, a former interior ministry official from the Meanchey district of Phnom Penh.
He said that in May 2019, Chinthean received $500,000 from a real estate businesswoman named Khan Khiev with the promise that he would help her obtain a license for an online casino operation in the province of Preah Sihanouk.
He added that after taking the money, he did not get her the license as promised.
Judge Tarachhath said that when the plaintiff asked for her money, Chinthean issued two checks for $500,000.
“When the plaintiff went to collect the money from his bank account, the defendant did not have the money and the checks were returned,” he added.
Judge Tarachhath said that to claim damages, the plaintiff filed a lawsuit against Chinthean in 2020, which led to the arrest of the defendant on August 4 of the same year.
On November 11, 2020, the Phnom Penh Municipal Court sentenced Chinthean to three years in prison after being charged with “fraud” under Sections 377 and 378 of the Penal Code and “issuing an insufficient check” under of section 231 of the Negotiable Securities Act. Instrument and payment transactions.
The court also ordered him to pay $500,000 in damages as well as $10,000 in compensation to the plaintiff.
Judge Tarachhath said the Court of Appeal on August 19 last year upheld the conviction.
